In a recent matter where SP&H was retained to value a metal distributorship, the opposing expert valued the whole business at about $95 million.  SP&H valued the same business at $9 million.   The judge determined that Nevin Sanli's opinion was the correct number for the business as stated in the excerpt below:

“The determination of  valuation when qualified experts reach inconsistent results does require the arbitrator's assessment of experience, competence, and rationality in the methods of analysis; here, the experience and careful analysis performed by respondents' expert Sanli is far more worthy of confidence, and is accepted by the arbitrator.  [Sanli’s] Exhibit 700 is a model of clarity for the presentation of an expert's opinion.”

The opposing expert did not have business valuation credentials.  He had a doctorate in economics and over 20 years of experience as a forensic consultant with a big 4 firm.
